Article 1 – Definitions

In these general terms and conditions, the following definitions apply:

Q-B&B Villa: the company that offers accommodation, lodging services, and related services.
Gift Voucher: a physical or digital voucher issued by Q-B&B Villa with a specific monetary value or package.
Purchaser: the natural person or legal entity purchasing a gift voucher.
User: the holder of the gift voucher who uses it for a reservation or payment.
Agreement: the agreement between Q-B&B Villa and the purchaser regarding the purchase and use of a gift voucher.

Article 2 – Applicability

1. These general terms and conditions apply to all gift vouchers issued by Q-B&B Villa.
2. By purchasing, receiving, or using a gift voucher, the purchaser and/or user agrees to these terms and conditions.
3. Deviations from these terms and conditions are only valid if expressly confirmed in writing by Q-B&B Villa.
4. If one or more provisions of these terms and conditions are found to be wholly or partially void or voidable, the remaining provisions shall remain fully in force.

Article 3 – Validity and Duration

1. 
   The gift voucher is valid for 5 years from the date of purchase, unless otherwise expressly stated.
   
2. After this period, the gift voucher automatically expires and can no longer be redeemed.
   
3. Q-B&B Villa is not obliged to extend or replace expired gift vouchers.
   
4. Any extension can only take place at the sole discretion of Q-B&B Villa.
   

Article 4 – Use of the Gift Voucher

1. The gift voucher can only be used for payment of services, overnight stays, packages, or other products offered by Q-B&B Villa.
   
2. The gift voucher can be used as full or partial payment.
   
3. If the total value of the reservation is higher than the balance of the gift voucher, the remaining amount must be paid by the user via a payment method accepted by Q-B&B Villa.
   
4. If the value of the reservation is lower than the balance of the gift voucher, the remaining amount will remain available until the end of the validity period.
   
5. The gift voucher may not be used for commercial resale without prior written permission from Q-B&B Villa.
   

Article 5 – Reservations and Availability

1. The use of a gift voucher is always subject to availability of accommodation and services.
   
2. Q-B&B Villa reserves the right to exclude certain dates, packages, or periods from use with gift vouchers, including but not limited to holidays, events, or peak periods.
   
3. When making a reservation, the user must indicate that a gift voucher will be used.
   
4. Q-B&B Villa may apply additional reservation conditions.
   

Article 6 – Cancellation, Modification, and No-Show

1. Reservations made with a gift voucher are subject to the cancellation conditions of Q-B&B Villa.
   
2. In case of timely cancellation, the amount can be re-used as credit as long as the gift voucher is still valid.
   
3. In case of a no-show or late cancellation, Q-B&B Villa may charge the full amount of the reservation or let the value of the gift voucher expire wholly or partially.
   
4. Changes to reservations are subject to availability and may incur additional costs.
   

Article 7 – Not Exchangeable for Cash

1. Gift vouchers are not exchangeable for cash or other monetary compensation.
   
2. Any remaining value will not be paid out in cash.
   
3. Gift vouchers cannot be used to purchase other gift vouchers unless Q-B&B Villa determines otherwise.
   

Article 8 – Loss, Theft, and Damage

1. Q-B&B Villa is not liable for loss, theft, damage, or unauthorized use of gift vouchers.
   
2. Lost or stolen gift vouchers will generally not be replaced or reimbursed.
   
3. Only original and valid gift vouchers will be accepted.
   

Article 9 – Fraud and Misuse

1. It is forbidden to forge, copy, modify, or in any way fraudulently use gift vouchers.
   
2. Q-B&B Villa reserves the right to declare a gift voucher invalid if there is fraud, misuse, or suspicion thereof.
   
3. In such cases, Q-B&B Villa is not obliged to provide any compensation.
   

Article 10 – Right of Withdrawal

1. If a gift voucher is purchased online by a consumer, a statutory cooling-off period of 14 days may apply, provided the card has not yet been used.
   
2. If the gift voucher has already been used wholly or partially, the right of withdrawal expires.
   
3. For reservations with a specific date, the statutory right of withdrawal may be excluded according to applicable law.
   

Article 11 – Liability

1. Q-B&B Villa is only liable for direct damage demonstrably resulting from intent or gross negligence by Q-B&B Villa.
   
2. Any liability of Q-B&B Villa is limited to a maximum of the value of the relevant gift voucher.
   
3. Q-B&B Villa is not liable for indirect damage, consequential damage, lost income, or missed savings.
   

Article 12 – Force Majeure

1. Q-B&B Villa is not liable for non-fulfillment of obligations if this is due to force majeure.
   
2. Force majeure includes: natural disasters, pandemics, government measures, fire, strikes, technical failures, or other circumstances beyond the reasonable control of Q-B&B Villa.
   

Article 13 – Amendment of Conditions

1. Q-B&B Villa reserves the right to amend these general terms and conditions.
   
2. The most current version of the terms and conditions will be published on the official website of Q-B&B Villa.
   
3. For already purchased gift vouchers, the terms and conditions valid at the time of purchase remain applicable, unless the amendment is to the benefit of the user.
   

Article 14 – Applicable Law and Disputes

1. These terms and conditions and all agreements relating to gift vouchers are governed by Belgian law.
   
2. Any disputes will be submitted to the competent court in the district where Q-B&B Villa is located.
